Terms & Conditions
These General Terms and Conditions (“GTC”) govern loans granted by Rajsi Infin Consultants Private Limited (“Lender”), a Non-Banking Financial Company registered with the Reserve Bank of India. Specific terms of each loan are set out in the Sanction Terms and loan agreement, which prevail in case of any inconsistency.
Definitions
“Borrower” includes any co-borrowers whose details are specified in the Sanction Terms. “Business Day” means a day (excluding Sundays) on which banks are generally open in Delhi. “Loan” means the loan amount specified in the Sanction Terms.
Loan Amount and Disbursal
The Lender disburses the loan into the account specified by the Borrower. The Borrower must use the loan only for the stated purpose and not for repaying any existing loan or for any immoral or illegal purpose without the Lender’s written approval. The Lender may cancel the loan, in which case the outstanding amount becomes payable within 15 days.
Interest and Penal Charges
Interest is payable as specified in the Sanction Terms/Repayment Schedule. The Lender may revise the rate of interest with notice to the Borrower. Penal charges on delayed payment are computed on the basis of a 365-day year.
Repayment
The Borrower shall repay the loan in the mode and manner specified in the Sanction Terms, including via NACH mandates, post-dated cheques or other approved methods. Rescheduling may attract additional charges. The Borrower bears all applicable taxes, including GST.
Representations and Obligations
The Borrower confirms that all information provided is true and complete, maintains required licences, complies with tax laws, notifies the Lender of any adverse change, provides financial documents on request and does not dispose of major assets or take on additional debt without approval.
Events of Default and Remedies
Default includes non-payment on due dates, breach of covenants, dishonour of payment instruments, insolvency proceedings or unapproved new debt. On default the Lender may terminate the loan, recall the outstanding amount, levy penal charges, invoke payment instruments and pursue remedies available under law.
Guarantee, Set-off and Joint Liability
Guarantors undertake to pay amounts due on demand; the guarantee is continuing. Obligations of Borrowers and Guarantors are joint and several. The Lender may set off amounts lying with it against dues.
Fees and Charges
The Borrower shall pay processing fees, documentation charges and enforcement costs as set out in the Sanction Terms, along with applicable taxes, which the Lender may deduct from the disbursal amount.
Disclosure and Credit Information
The Lender may disclose information to the Reserve Bank of India, credit information companies and other authorised institutions. Names of defaulters may be published as permitted by law.
Assignment
The Borrower may not assign its rights without approval. The Lender may assign, transfer or securitise its interests.
